These terms are a plain-language agreement between you and Kintail. Please read them — using Kintail means you agree to them.

1Who we are
Kintail (“Kintail”, “we”, “us”, “our”) is a dog-tracking app and website — a warm, private journal for your pup. Kintail is operated under the registered business name Kintail App. The app and the website at kintail.app are together the “Service”.
2Accepting these terms
By downloading, accessing, or using the Service, you agree to these Terms of Service (the “Terms”) and to our handling of your information as described in section 12. If you do not agree, please do not use the Service.
3Who can use Kintail
You must be at least 16 years old and able to enter into a binding agreement to use Kintail. The Service is not directed at children. If you use Kintail on behalf of a household, you confirm you are authorised to accept these Terms for that use.
4Your account
- Keep your sign-in details secure — you are responsible for activity under your account.
- Give us accurate information and keep it up to date.
- Tell us promptly (see section 16) if you believe your account has been used without your permission.
5Using the service
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own, non-commercial use, in line with these Terms. You agree not to misuse the Service — for example, by interfering with it, attempting to access it in unauthorised ways, reverse-engineering it, or using it to break the law or infringe someone else’s rights.
6Your content
You own the content you create in Kintail — your entries, notes, pet details, photos, and other information (“Your Content”). Kintail stores your content as plain, portable text you can export at any time.
To run the Service, you grant us a limited licence to host, store, back up, process, and display Your Content — only as needed to provide the Service to you and to anyone you choose to share it with (such as your household or a community group). We do not sell Your Content. You are responsible for Your Content and confirm you have the rights to it and that it does not break these Terms or the law.
7Community groups & conduct
Kintail lets you share your pup’s progress with people you invite — your household, and community groups you join by link, code, or QR. What each pet shares is always your choice, per group.
Zero tolerance. There is zero tolerance for objectionable content and abusive users. You must not post or share anything that is hateful, harassing, threatening, sexual, or otherwise abusive, or that demeans a person or their pet, and you must not harass or abuse other members.
- You can report any content or member, and block a member so the two of you no longer see each other.
- Every report is reviewed and acted on — content or accounts in breach are removed, usually within 24 hours.
- We may remove content, and suspend or terminate accounts, that breach these Terms or our community guidelines.
- Share only what you are comfortable with other members seeing, and never share someone else’s private information.
8Not veterinary advice
Kintail is a journaling and tracking tool, not a source of veterinary, medical, or professional advice. Its insights, tips, charts, and estimates are for general information only and may be incomplete or wrong. Always consult a qualified veterinarian about your pet’s health, diet, and care — and seek urgent help for any emergency. You rely on Kintail’s content at your own discretion.
9Subscriptions & payments
- Kintail is free to start. Some features (such as Kintail+ and Family plans) require a paid subscription.
- Subscriptions are billed through the app store you signed up with (Apple App Store or Google Play) or our web billing provider, and are subject to that provider’s terms as well as these Terms.
- Paid subscriptions renew automatically for the period you chose until cancelled. You can manage or cancel a subscription through your app store account or your Kintail billing settings; cancelling stops future renewals but does not refund the current period, except where required by law (see section 10).
- Current prices are shown in the app before you subscribe. We may change prices or the features included in a plan; where a change affects an active subscription, we will give you reasonable notice and, where required, the chance to cancel.
10Australian Consumer Law
Our Service comes with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the ACL or any other law that cannot lawfully be excluded.
Where we are permitted to limit our liability for a failure to comply with a consumer guarantee (other than a guarantee as to title, undisturbed possession, or undisclosed securities), our liability is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
11Disclaimers & liability
Subject to section 10, and to the fullest extent permitted by law:
- The Service is provided “as is” and “as available”. We do not guarantee it will be uninterrupted, error-free, or that data will never be lost — so keep your own copies of anything important (you can export your data at any time).
- We are not liable for any indirect, incidental, special, or consequential loss, or for loss of data or profits, arising from your use of (or inability to use) the Service.
- To the extent we may lawfully limit it, our total liability to you for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose.
12Your privacy
We handle your personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. In short: we collect only what we need to run the Service, we do not sell your personal information, and we store your dog’s history as plain, portable text you can export at any time. You can ask us to access, correct, or delete your personal information by contacting us (section 16).
13Suspension & termination
You can stop using Kintail at any time and can delete your account from within the app. We may suspend or end your access if you materially or repeatedly breach these Terms, or where we must to comply with the law or protect other users. Where practical, you will be able to export your data before your account is deleted. Sections that by their nature should survive (such as 6, 10, 11, and 15) continue after termination.
14Changes to these terms
We may update these Terms from time to time — for example, as the Service changes or the law changes. If a change is material, we will give you reasonable notice (such as an in-app notice or an update to the community guidelines version). Continuing to use the Service after a change takes effect means you accept the updated Terms.
15Governing law
These Terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
